THCA Legality

THCA is through raw cannabis. When cannabis is heated or smoked, THCA is converted into THC through a process known as decarboxylation. However, consuming raw cannabis allows for the therapeutic benefits of THCA to be realized without the psychoactive effects of THC.

Is THCA legal?

  • The 2018 Farm Bill and subsequent explanations by the DEA make it clear that the only cannabinoid currently defined as “marijuana” under the Controlled Substances Act is delta-9 tetrahydrocannabinol, the final and most common form of THC. As a result, THCA is considered to be industrial hemp, the same regulatory category as CBD or CBG.

THCA vs. THC

  • If you apply enough heat when you use this cannabinoid, the effects of THCA are exactly the same as the effects of THC. These two cannabinoids are inherently different, however, due to the carboxyl group attached to THCA that disappears when it transforms into THC. Until this transformation takes place, the THC molecule can’t properly bind to its neuroreceptor sites.

 

Hemp derived delta-9 THC

Delta 9 THC, also known as delta-9-tetrahydrocannabinol, is a chemical found in both medical marijuana and cannabis plants (Cannabis sativa). It is one of the primary cannabinoids which are responsible for producing effects on the body and mind when consumed. For many years, the psychoactive effect of cannabis products were widely misunderstood, with movies like Reefer Madness portraying exaggerated and inaccurate information. However, with the passage of the 2018 Farm Bill, it became federally legal to buy and sell industrial hemp cannabis products (which have low THC levels) at the federal level.
